Must-Known Drone laws in Germany (in 2024)

Berlin (Brussels Morning Newspaper) – If you want to fly a drone in Germany it is considered legal. According to the National Aviation Authority, you can fly a drone by following the right rules. You must find out the drone regulations before flying. Germany is on the verge of becoming the next country to enforce laws regarding the use of drones. The legislation of this country covers a lot of topics. In this guide, you will find all the drone laws in Germany.

General Rules for Flying A Drone within the European Union

The national aviation authority of Germany has set some rules regarding the use of a drone. It is legal but you need to follow the regulations properly. Germany is a popular country that is a part of the European Union. Therefore, it must comply with the regulations stated by the UAV. Here are some important rules to follow:

  • Drone flyers cannot fly the drone above 100 meters without a permit
  • While in the controlled airspace the maximum altitude will be 50 meters which is 164 feet
  • Drone pilots have to maintain a direct line of sight with their drones all the time
  • According to research, there is an exception in the case of FPV flights. In this condition, your drone can fly not higher than 30 meters above the ground. It shouldn’t weigh more than 250 grams
  • You cannot fly a drone at night that is over 5kg that is 11 pounds
  • Drones that are 11 pounds will not flow without a permit. However, you need a license required to fly a drone. Make sure that the drone is not more than 4.4 pounds
  • Users require drone insurance relating to drone operations
  • The drone flyer cannot be flown within 1.5 km or closer to the airport
  • All drones that weigh more than 250 grams or more have to be labeled correctly. It must have a fireproof badge that features the name and address of the drone operator
  • You cannot fly the drone over crowds, industrial areas, prisons, and other sensitive areas. If you cannot follow these rules you may get banned
  • It is not allowed to fly a drone above a distance of 100 meters. If you are closer to federal highways, waterways, and railway facilities, it is necessary to follow these rules
  • Drones cannot fly near conservation areas that are safe under the Federal Nature Conservation Act
  • You cannot record or have any radio signals that are over the residential or commercial areas

How Can You Operate A Drone Under These Laws?

  • You can fly a drone in an open category it has one of the class identification with a label 0,1,2,3 or 4
  • The only exception is that if you have recently purchased a drone it may not have an identification label
  • Your drone can have a maximum take-off mass lesser than 25 kg
  • The drone pilot must fly a drone away from crowded places for the safety of people
  • You cannot operate a drone directly over people or other creatures. When there is a class identification label only then you can make a move. It is necessary to know the rules regarding various operations A1, A2, and A3
  • The remote pilot must remain within a visual line of sight
  • As a drone pilot, you cannot operate a drone above 120m
  • Your drone must have to carry any dangerous goods or other intense materials

Prohibition and Restrictions

  • There are general rules that the drone flyer must comply with. When operating with the UAS your drone cannot exceed the weight of 25 kg. You have to keep the drone in a visible line of sight. If the weather is not good it is best not to fly a drone.
  • If you don’t follow the right rules you can easily get a ban by the aviation authority. You always need to keep public safety in mind before flying a drone. The UAS will not let you operate within a restricted flight area
  • As per section 17 of the Air Traffic Regulation, you can only get an exception in certain cases. If you fly near the airfield or a landing location, it is an offense.
  • Any restriction on flying a drone will not apply if the operator is out of the visible line of sight for agricultural purposes.
  • You cannot fly a UAS that is more than 1.5 km from an airport. If you are doing so without a permit it is a punishable act
  • Due to the dangers involved with drone flying need certification and license
