Brussels strengthens control of municipal non-profit organizations

Brussels, (Brussels Morning)- The Brussels government has given the green light for a draft ordinance that makes it possible to strengthen and improve the control of municipal non-profit organisations. This was reported by the competent Minister of Local Government Bernard Clerfayt (Défi) on Friday.

After the political-financial scandal at Samusocial, very strict beacons were put in place, which ultimately made the control of municipal non-profit associations ineffective and inefficient. This happened partly due to administrative overload and too short inspection periods,this is reported by a BRUZZ reporter. 

“Under the emotion of the various scandals, the previous legislator had taken extensive measures in response to the facts brought to light. In practice, however, the control of municipal non-profit associations can and must be improved”, says Bernard Clerfayt (Défi). That is why he drafted a new ordinance that makes it possible to strengthen the control of municipal non-profit associations.

The reform is based on two principles. The first level of control of a municipal non-profit organisation is the municipality itself, which must ensure that the non-profit organisation that created it complies with the applicable legislation and the principles of good governance.

Beyond the municipal level

Nevertheless, for some non-profit organisations the importance of supervision goes beyond the municipal level. This may be due to the nature of the deed, its author or the amounts involved. Consequently, a distinction is made on the basis of the size of the non-profit associations: “micro”, “small” and “large” non-profit organisations.

All non-profit associations must provide the government with the fundamental and constitutional deeds of a non-profit association: the statutes and their amendments, the management contract and its amendments, as well as the annual accounts.

The small non-profit associations will also have to submit all documents relating to public contracts of more than 175,000 euros and a list of the deeds approved by their management bodies.

The large non-profit associations must also provide the deeds to revoke or justify a suspended deed; the deeds of the general meeting; the similarities; taking out loans and acquiring or disposing of property rights or rights in immovable property.

Control

In order to facilitate the control of the non-profit associations, the deeds of all non-profit associations and the detailed lists drawn up by the small and large non-profit organisations will also be sent to the municipality in order to be able to guarantee a control by the municipal corps.

Finally, Brussels Local Authorities will publish an updated list of municipal non-profit organisations every year.
